Experienced Attorneys Addressing Construction Zone and School Zone Violations

Illinois is very strict about speed limits in construction and school zones. Failure to follow the rules and regulations for driving in construction and school zones in Illinois could lead to severe penalties. At Beck & Houlihan, P.C., our attorneys provide skilled traffic violation representation for drivers who have been cited for speeding in construction or school zones in DuPage, Kane and Will counties. We will use this significant experience to help pursue a favorable outcome in your case.

Construction or Maintenance Speed Zones

State law defines a construction or maintenance speed zone as an area in which the department, Toll Highway Authority, or local agency has posted signage advising drivers of such a zone or a lower speed limit they must follow. These signs state the fine amount for violations as well, so drivers who do speed are aware they may face penalties if they speed. The first violation for speeding in a construction zone results in a minimum fine of $250, and a second or subsequent offense is $750. If the second or subsequent violation occurs within two years of the first, your license could be suspended for 90 days.

Traffic Violations in School Zones

On a school day (from 7 a.m. to 4 p.m.) when school children are present, it is illegal to drive more than 20 mph while passing through a school zone, drive on a roadway on public school property, or travel on any public thoroughfare where children pass going to and from school. However, appropriate signs must be posted in these areas, which give proper warning that a school zone is being approached and indicate the specific speed limit. “Schools” are defined as:

  • Public or private primary or secondary schools
  • Primary or secondary schools operated by religious institutions
  • Public, private, or religious nursery schools

The fine for the first violation of speeding in a school zone is $150. Second or subsequent violations carry a minimum fine of $300. Since court supervision is not available for a school zone violation, it is important to seek the representation of one of our attorneys if you want to avoid a conviction.
